Shop terms and conditions

1. About us and our shop

All profits from the online shop will go towards supporting the work of Epilepsy Society (a Registered Charity No. 206186 and a Company Limited by Guarantee No. 492761).  Our VAT number is GB20781068.

If you are phoning from outside the UK, prefix number with 44 and omit the first 0.

3. Do you live outside the UK?

Our online shop is only intended for use by people resident in the United Kingdom.  We are only able to accept orders for UK postal addresses. If you live outside the UK, we regret that we cannot accept your order via the online shop. If you wish, you can instead place an order by writing to us, however please contact us first to check what the postage and packing charge will be for your order (see contact details below).

4. Your status

4.1 By placing an order though our Site, you warrant that:

4.1.1 You are legally capable of entering into binding contracts;

4.1.2 You are at least 18 years old; and

4.1.3 You are requesting that the Products are delivered to a United Kingdom postal address.

5. Making the contract between you and us

5.1 After placing an order, you will receive an e-mail from us acknowledging that we have received your order ("Acknowledgment E-mail").  Please note that this does not mean that your order has been accepted. 

5.2 Your order constitutes an offer to purchase the Products from us.  By completing and submitting the order you are making an offer to purchase the Products selected which, if accepted by us, will result in a binding contract.

5.3 All orders are subject to availability and are subject to acceptance by us.  We will confirm such acceptance to you by sending you an e-mail that confirms that the Products have been dispatched ("Confirmation E-mail").  This Confirmation E-mail will contain your order number, details of the Products ordered, total cost of the Products, delivery details etc.

5.4 The contract between us will only relate to those Products dispatched we have confirmed in the Confirmation E-mail.

6. Disclaimer

We may provide links on our site to the websites of other companies, whether affiliated with us or not. We cannot give any undertaking, that products you purchase from third party sellers through our site, or from companies to whose website we have provided a link on our site, will be of satisfactory quality, and any such warranties are disclaimed by us absolutely. This disclaimer does not affect your statutory rights against the third party seller. We will notify you when a third party is involved in a transaction, and we may disclose your customer information related to that transaction to the third party seller.

7. Returns and your rights

7.1 If you change your mind about items you have ordered, you may cancel within seven working days of receiving the Products.

7.2 If you wish to cancel, you should inform us in writing at the address above, and return the Products to us in their original packaging and in the same condition in which you received them.

7.3 If you return the Products in accordance with the above, we will refund the full cost of the Products as soon as possible and, in any case, within 30 days of the day you have given notice of your cancellation, however we will notrefund the cost of postage and packing, nor will we pay for the cost of returning the Products to us.

7.4 If you return a Product to us for any reason other than changing your mind (for example because you claim that the Product is defective), we will examine the returned Product and will notify you of your refund via e-mail within a reasonable period of time.  We will process the refund due to you as soon as possible and, in any case, within 30 days of the day we confirmed to you via e-mail that you were entitled to a refund for the defective Product.  Products returned by you because of a defect will be refunded in full, including a refund of the delivery charges for sending the item to you and the cost incurred by you in returning the item to us.

7.5 This clause 7 does not affect your statutory rights.

8. Delivery

We will normally send your order to you within 10 working days, unless there are exceptional circumstances. We can only deliver to addresses within the UK. In the case of a mixed order, Products may be dispatched in two separate packages and may arrive on separate days. Any orders placed on or after 17th December may not arrive in time for Christmas.

9. Postage and packing

Any orders placed on or after the 17th December may not arrive in time for Christmas.

9.1 All information items (leaflets, factsheets, books, CDs, DVDs etc) purchased have postage and packing charges included in the price quoted.

9.2 For merchandise, Christmas cards and stocking fillers, the charges for postage and packing will depend on the value of your order. The postage and packaging charges will be based on the following:

9.3.1 £0.95 for orders between 0.01p to £4.00

9.3.2 £2.95 for orders between £4.01 to £20.00

9.3.3 £3.95 for orders between £20.01 to £40.00

9.3.4 £4.95 for orders between £40.01 to £50.00; and

9.3.5 £6.95 for orders over £50.01.

10. Prices

10.1 The price of any Products will be as quoted on our Site from time to time, except in cases of obvious error.

10.2 Our prices include VAT where applicable (books and leaflets, for example, are exempt from VAT) but exclude postage and packing costs, which will be added to the total amount due.

10.3 Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Confirmation E-mail.

11. Payment

11.1 We accept payments via SECPay.  Please see security information below.

11.2 Payment is accepted using Mastercard, Visa Debit, Visa Delta, Visa Connect, and Visa.

11.3 If you would prefer not to pay over the internet, you can contact us to order over the phone or request an order form from us (please see contact details above). A receipt will be sent with the Products when dispatched.

12. Credit card security

We have contracted with SagePay to process credit card transactions on this Site. SagePay provides all the security required for the transmission and storage of card details.  Information transmitted online is encrypted to ensure that the transaction is secure. You will know that you are on a secure webpage when you see https:// in the address bar, rather than just http:// as on other pages; the 's' stands for 'secure'. In addition, when you are on a secure page, a lock icon will appear on the bottom of web browsers such as Netscape Navigator and Microsoft Internet Explorer.

13. Risk and title

13.1 The Products will be at your risk from the time of delivery.

13.2 Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including any delivery charges, or on the date when the Products are delivered to you, whichever is the later.

14. Our liability

14.1 We warrant to you that any Product(s) purchased from us through our Site is of satisfactory quality and reasonably fit for all the purposes for which Products of the kind are commonly supplied.

14.2 Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the Product(s) you purchased and any losses which are a foreseeable consequence of us breaking the agreement. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

14.3 This does not include or limit in any way our liability:

14.3.1 For death or personal injury caused by our negligence;

14.3.2 Under section 2(3) of the Consumer Protection Act 1987;

14.3.3 For fraud or fraudulent misrepresentation; or

14.3.4 For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.

14.4 We are not responsible for indirect losses which happen as a side effect of the main loss or damage and which are not foreseeable by you and us, including but not limited to:

14.4.1 loss of income or revenue;

14.4.2 loss of business; or

14.4.3 loss of profits or contracts; provided that this clause 14.4 shall not prevent claims for loss of or damage to your tangible property that fall within the terms of clause 14.1 or clause 14.2 or any other claims for direct financial loss that are not excluded by any of categories of this clause 14.4.

14.5 The Products for sale on this Site are designed for information purposes only and are not concerned with providing specific medical advice.  Commentary and other materials available for purchase from our Site are not intended to amount to advice on which reliance should be placed.  We therefore disclaim all liability and responsibility arising from any reliance placed on such materials, or by anyone who may be informed of any of the contents of the Products.

14.6 The information contained in the Products (where applicable) has been drafted using relevant references so that so far as is possible the information represents the consensus view of UK medical practice and opinion.  Where appropriate, relevant specialist organisations have been approached for information, and approval has been given by the Epilepsy Society medical director. The information should not be used for diagnosing or treating a health problem.

14.7 If you have or suspect you may have a health problem, you should consult a suitably qualified professional.  The information contained in the Products is not intended to be a substitute for medical guidance from your own doctors. We cannot be held responsible for any actions taken as a result of using Epilepsy Society information resources.

14.8 The information contained in the Products available on this Site is applicable in the UK. Other countries may have different regulations or available drug treatments, and drugs may be licensed differently.

15. Privacy

At Epilepsy Society, we are committed to protecting your privacy. We will collect information from you so that we can process orders and provide the best service possible. When you give us your credit card details, this information is treated securely (see security information above). We will not email you in the future unless you have given your consent.  Any information that you give to us whilst using our online shop shall be dealt with in accordance with our Privacy and Cookie Policy.

16. Communications between us and you

Applicable laws require that some of the information or communications we send to you should be in writing. When using our Site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

17. Notices

All notices given by you to us must be given to us at the address or e-mail address shown above. We may give notice to you at either the e-mail or postal address you provide to us when placing an order, or in any of the ways specified in clause 15 above. Notice will be deemed received immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

18. General

18.1 We shall not be liable to you for any delay or non-performance of our obligations under this Agreement arising from any cause or causes beyond our reasonable control including without limitation any of the following: act of God, governmental act, war, fire, flood, explosion or civil commotion.

18.2 No waiver by us of any breach of these terms and conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

18.3 These terms and conditions set out the entire agreement between you and us.  They supersede any previous agreement or understanding and may not be varied except in writing between you and us.

18.4 If any of these terms and conditions or any provisions of a contract between us are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

18.5 We may revise or amend these terms and conditions from time to time.  You will be subject to the terms and conditions in force at the time that you order Products from us, unless we notify you of the change to these terms and conditions before we send you the Confirmation E-mail (in which case we have the right to assume that you have accepted the change to these terms and conditions, unless you notify us to the contrary within seven working days of receipt of the Products).

18.6 The interpretation, construction, effect and enforceability of these terms and conditions shall be governed by English Law, and you and we agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.
